Artikel 1 — Algemeen

1.1 Deze algemene voorwaarden zijn van toepassing op alle cursussen, workshops, activiteiten en overeenkomsten van Stichting Theaterschool De Zuiderlingen, ongeacht de locatie waar deze plaatsvinden.

1.2 Door inschrijving voor een cursus, workshop of activiteit verklaart de cursist/deelnemer, dan wel diens ouder of wettelijk vertegenwoordiger, kennis te hebben genomen van en akkoord te gaan met deze algemene voorwaarden.

1.3 Bezoekers, waaronder cursisten, leerlingen, gasten, ouders/verzorgers en andere aanwezigen, dienen zich te houden aan de geldende huisregels van Theaterschool De Zuiderlingen en aanwijzingen van de directie, docenten, vrijwilligers en overige medewerkers op te volgen.

1.4 Stichting Theaterschool De Zuiderlingen behoudt zich het recht voor deze algemene voorwaarden te wijzigen. De meest actuele versie van de algemene voorwaarden is te allen tijde beschikbaar via de website van Theaterschool De Zuiderlingen.

Artikel 2 — Proefles, inschrijving & toelating

2.1 Personen die interesse hebben in een cursus van Theaterschool De Zuiderlingen kunnen voorafgaand aan inschrijving een gratis proefles volgen. Het volgen van een proefles is uitsluitend mogelijk na aanmelding via de website.

2.2 Een proefles heeft als doel de deelnemer de gelegenheid te bieden te beoordelen of de cursus, de lesvorm en de groep passend zijn bij zijn of haar wensen, verwachtingen en mogelijkheden.

2.3 Daarnaast dient een proefles als kennismakingsmoment voor de docent en Theaterschool De Zuiderlingen om te beoordelen of de deelnemer past binnen de betreffende groep en of de cursus aansluit bij de mogelijkheden en behoeften van de deelnemer.

2.4 Het volgen van een proefles geeft geen automatisch recht op plaatsing of toelating tot een cursusgroep. Theaterschool De Zuiderlingen behoudt zich het recht voor een deelnemer niet toe te laten tot een cursusgroep indien de docent en/of directie van oordeel is dat plaatsing niet in het belang is van de deelnemer, de groep, de veiligheid binnen de groep of de kwaliteit van het onderwijs. Plaatsing is ook niet mogelijk als de groep vol is.

2.5 Inschrijven voor een cursus kan alleen via de website www.theaterschool-dezuiderlingen.nl.

2.5.1 Bij inschrijving van een minderjarige cursist/deelnemer dient een ouder of wettelijk vertegenwoordiger akkoord te geven op de inschrijving.

2.6 Op de website kiest de klant bij inschrijving op basis van zijn/haar beschikbaarheid voor de betreffende cursus. Lesdagen en tijdstippen staan vermeld op de website.

2.7 Indien men zich niet meer voor de gewenste cursus kan inschrijven omdat de cursus is volgeboekt, kan de klant ervoor kiezen een belangstellingsregistratie op de website in te vullen. Indien een nieuwe cursus wordt gestart ontvangt de klant hierover bericht.

2.8 Inschrijven voor een cursus kan alleen op de data en tijden die door Stichting Theaterschool De Zuiderlingen zijn vastgesteld. De juiste lesdata staan vermeld op de website.

2.9 Na inschrijving en toelating ontvangt de cursist per e-mail een inschrijfbevestiging.

2.10 Na afloop van het seizoen wordt de inschrijving stilzwijgend verlengd voor dezelfde periode.

2.11 De laatste instroommogelijkheid voor een cursus is vanaf de eerste les van januari van het lopende cursusjaar.

Artikel 3 — Opzegging

3.1 Inschrijving voor een cursus geldt voor de duur van het volledige cursusjaar.

3.2 Tussentijdse opzegging gedurende het cursusjaar is niet mogelijk, behalve in de onderstaande gevallen.

3.2.1 De cursist zegt schriftelijk op vóór het einde van de eerste termijn (herfstvakantie) van het lopende cursusjaar.

3.2.2 De cursist verhuist buiten het werkgebied van Theaterschool De Zuiderlingen. Op verzoek dient een bewijs van adreswijziging te worden overgelegd.

3.2.3 De cursist kan de cursus wegens medische redenen duurzaam niet langer volgen. Theaterschool De Zuiderlingen kan verzoeken om een verklaring van een arts of andere bevoegde zorgverlener.

3.3 Opzegging dient te geschieden via het daarvoor bestemde afmeldformulier op de website van Theaterschool De Zuiderlingen.

3.4 Eventuele restitutie van cursusgelden als gevolg van een geldige tussentijdse opzegging wordt behandeld overeenkomstig de bepalingen in artikel 5 van deze algemene voorwaarden.

Artikel 4 — Afmelding

4.1 Indien een cursist wegens ziekte, verhindering of andere omstandigheden niet aanwezig kan zijn bij een les, dient de cursist zich uiterlijk 2 uur vóór aanvang van de les af te melden bij de desbetreffende docent.

4.2 Afmelden kan per e-mail, telefonisch of via een privébericht aan de desbetreffende docent.

4.3 Door de cursist gemiste lessen kunnen niet worden ingehaald, tenzij Theaterschool De Zuiderlingen hierover uitdrukkelijk anders beslist.

4.4 Afwezigheid van een cursist, ongeacht de reden daarvan, geeft geen recht op restitutie van cursusgelden, behoudens de uitzonderingen genoemd in deze algemene voorwaarden.

Artikel 5 — Restitutie

5.1 Restitutie van cursusgelden is uitsluitend mogelijk in de gevallen genoemd in artikel 3 van deze algemene voorwaarden.

5.2 Afwezigheid van een cursist, ongeacht de reden daarvan, geeft geen recht op restitutie van cursusgelden.

5.3 Door een cursist gemiste lessen kunnen niet worden gerestitueerd.

5.4 Indien lessen door toedoen van Theaterschool De Zuiderlingen uitvallen, bestaat recht op restitutie vanaf de derde uitgevallen les binnen hetzelfde cursusjaar. Alleen het cursusgeld dat betrekking heeft op de uitgevallen lessen komt voor restitutie in aanmerking.

5.5 Indien Theaterschool De Zuiderlingen besluit een cursus tussentijds te beëindigen, heeft de cursist recht op restitutie van het cursusgeld dat betrekking heeft op de resterende lessen.

5.6 Indien Theaterschool De Zuiderlingen besluit een cursus of workshop vóór de startdatum te annuleren, wordt het reeds betaalde cursus- of workshopgeld volledig gerestitueerd.

5.7 Restitutie van workshopgelden is uitsluitend mogelijk indien de deelnemer zich uiterlijk twee weken vóór aanvang van de workshop schriftelijk afmeldt. Bij afmelding binnen twee weken vóór aanvang van de workshop vindt geen restitutie plaats.

5.8 Indien een cursist op grond van artikel 3.2.1 de inschrijving beëindigt vóór het einde van de eerste termijn (herfstvakantie) van het lopende cursusjaar, bestaat geen recht op restitutie van het eerste termijnbedrag. Reeds betaalde cursusgelden die betrekking hebben op de resterende termijnen worden gecrediteerd of gerestitueerd.

Artikel 6 — Belangstellingsregistratie

6.1 Indien een cursus is volgeboekt, kan een belangstellingsregistratie worden ingevuld via de website van Theaterschool De Zuiderlingen.

6.2 Een belangstellingsregistratie geldt uitsluitend als blijk van interesse en geeft geen recht op plaatsing, toelating of voorrang bij inschrijving voor een cursus.

6.3 Indien voldoende belangstelling bestaat voor een aanvullende cursusgroep, behoudt Theaterschool De Zuiderlingen zich het recht voor een extra cursus of cursusgroep te organiseren. Personen die een belangstellingsregistratie hebben ingevuld, worden hiervan per e-mail op de hoogte gesteld.

6.4 Een belangstellingsregistratie vervalt automatisch aan het einde van het cursusseizoen en wordt niet automatisch overgenomen naar een volgend cursusseizoen.

Artikel 7 — Tarieven

7.1 De actuele tarieven van cursussen, workshops en overige activiteiten van Theaterschool De Zuiderlingen worden gepubliceerd op de website.

7.2 Alle vermelde tarieven zijn in euro's en gelden voor het betreffende cursus- of activiteitenaanbod zoals gepubliceerd op de website.

7.3 Aan cursisten van 21 jaar en ouder wordt, indien wettelijk van toepassing, het geldende btw-tarief in rekening gebracht.

7.4 Theaterschool De Zuiderlingen behoudt zich het recht voor tarieven aan te passen. Tariefswijzigingen hebben geen invloed op reeds tot stand gekomen inschrijvingen voor het lopende cursusjaar, tenzij sprake is van wettelijke prijsverhogingen of wijzigingen in belastingen.

7.5 Voor aanvullende activiteiten, projecten, voorstellingen, workshops of speciale cursussen kunnen afwijkende tarieven gelden.

Artikel 8 — Betalingen

8.1 Door inschrijving voor een cursus, workshop of activiteit gaat de cursist/deelnemer, dan wel diens ouder of wettelijk vertegenwoordiger, akkoord met de geldende tarieven en de daaruit voortvloeiende betalingsverplichting.

8.2 Bij inschrijving kan gekozen worden voor betaling van het volledige cursusbedrag in één termijn of voor betaling in vier termijnen.

8.3 Indien wordt gekozen voor betaling in termijnen, worden hiervoor termijnkosten in rekening gebracht.

8.4 De cursist/deelnemer zorgt ervoor dat er voldoende saldo beschikbaar is op de opgegeven rekening op het moment van incasso.

8.5 Het niet deelnemen aan lessen, workshops of activiteiten ontslaat de cursist niet van de betalingsverplichting.

8.6 Bij inschrijving tot en met de herfstvakantie van het lopende cursusjaar is het volledige cursusbedrag verschuldigd.

8.7 Cursisten die na de herfstvakantie gedurende het cursusjaar instromen, kunnen in aanmerking komen voor een aangepast cursusbedrag naar rato van het resterende deel van het cursusjaar.

8.8 Theaterschool De Zuiderlingen behoudt zich het recht voor om gedurende het cursusjaar aanvullende cursussen, workshops of activiteiten aan te bieden waarvoor afwijkende tarieven kunnen gelden.

Artikel 9 — Aansprakelijkheid

9.1 Deelname aan cursussen, workshops, voorstellingen en overige activiteiten van Theaterschool De Zuiderlingen geschiedt geheel op eigen risico.

9.2 Theaterschool De Zuiderlingen is niet aansprakelijk voor schade, verlies of diefstal van eigendommen van cursisten, deelnemers, bezoekers of andere aanwezigen.

9.3 Theaterschool De Zuiderlingen is niet aansprakelijk voor letsel, ongevallen of andere schade die ontstaat tijdens of als gevolg van deelname aan cursussen, workshops, voorstellingen of overige activiteiten, tenzij sprake is van opzet of grove nalatigheid van Theaterschool De Zuiderlingen.

9.4 De cursist/deelnemer blijft te allen tijde zelf verantwoordelijk voor zijn of haar persoonlijke eigendommen.

9.5 Ouders, verzorgers of wettelijke vertegenwoordigers van minderjarige cursisten blijven verantwoordelijk voor de begeleiding van hun kind buiten de lesuren en buiten de door Theaterschool De Zuiderlingen georganiseerde activiteiten.

Artikel 10 — Portretrecht

10.1 Door aanvaarding van deze algemene voorwaarden stemt de cursist in met het gebruik door Stichting Theaterschool De Zuiderlingen van foto’s en/of filmpjes waarop hij/zij is afgebeeld.

10.2 Indien een cursist wenst niet herkenbaar in beeld te worden gebracht kan dit per mail worden aangegeven. Voor overige vragen kunt u contact opnemen via [email protected]

Artikel 11 — Veiligheid en groepsdynamiek

11.1 Theaterschool De Zuiderlingen streeft naar een veilige, respectvolle en inclusieve leeromgeving voor alle cursisten, docenten, vrijwilligers en andere betrokkenen.

11.2 Van iedere cursist wordt verwacht dat deze zich respectvol gedraagt tegenover medecursisten, docenten en overige aanwezigen en bijdraagt aan een positieve groepsdynamiek.

11.3 Indien een cursist door gedrag, houding of handelen de veiligheid, het welzijn of de groepsdynamiek van de cursusgroep verstoort, behoudt Theaterschool De Zuiderlingen zich het recht voor passende maatregelen te treffen.

11.4 Deze maatregelen kunnen onder meer bestaan uit een waarschuwing, een gesprek met de cursist en/of diens ouder(s) of wettelijke vertegenwoordiger(s), tijdelijke uitsluiting van lessen of definitieve verwijdering uit de cursusgroep.

11.5 De beoordeling of er sprake is van een verstoring als bedoeld in artikel 11.3 ligt uitsluitend bij de directie van Theaterschool De Zuiderlingen, eventueel na overleg met de betreffende docent.

11.6 Een besluit tot tijdelijke of definitieve verwijdering uit een cursusgroep geeft niet automatisch recht op restitutie van reeds betaalde cursusgelden.

General Terms
Theaterschool De Zuiderlingen

Article 1 — General

1.1 These general terms and conditions apply to all courses, workshops, activities and agreements of Stichting Theaterschool De Zuiderlingen, regardless of the location where they take place.

1.2 By enrolling in a course, workshop or activity, the student/participant, or their parent or legal representative, declares that they have taken note of and agree to these general terms and conditions.

1.3 Visitors, including students, pupils, guests, parents/guardians and other attendees, must comply with the applicable house rules of Theaterschool De Zuiderlingen and follow the instructions of the management, teachers, volunteers and other staff members.

1.4 Stichting Theaterschool De Zuiderlingen reserves the right to amend these general terms and conditions. The most recent version of the general terms and conditions will at all times be available via the website of Theaterschool De Zuiderlingen.

Article 2 — Trial Lesson, Enrolment & Admission

2.1 Persons interested in a course at Theaterschool De Zuiderlingen may attend a free trial lesson prior to enrolment. Participation in a trial lesson is only possible after registration via the website.

2.2 The purpose of a trial lesson is to give the participant the opportunity to determine whether the course, the teaching method and the group are suitable for his or her wishes, expectations and abilities.

2.3 In addition, a trial lesson serves as an introductory meeting for the teacher and Theaterschool De Zuiderlingen to assess whether the participant fits within the relevant group and whether the course matches the participant's abilities and needs.

2.4 Attending a trial lesson does not automatically entitle a participant to placement in or admission to a course group. Theaterschool De Zuiderlingen reserves the right not to admit a participant to a course group if the teacher and/or management considers that placement is not in the best interests of the participant, the group, the safety within the group, or the quality of education. Placement is also not possible if the group is full.

2.5 Enrolment for a course is only possible via the website www.theaterschool-dezuiderlingen.nl.

2.5.1 When enrolling a minor student/participant, a parent or legal representative must approve the enrolment.

2.6 On the website, the client selects the relevant course during enrolment based on his/her availability. Course days and times are listed on the website.

2.7 If enrolment for the desired course is no longer possible because the course is fully booked, the client may choose to complete an expression of interest registration on the website. If a new course is started, the client will be informed accordingly.

2.8 Enrolment for a course is only possible on the dates and times determined by Stichting Theaterschool De Zuiderlingen. The correct lesson dates are listed on the website.

2.9 After enrolment and admission, the student will receive a confirmation of enrolment by email.

2.10 At the end of the season, the enrolment will be automatically renewed for the same period.

2.11 The last opportunity to join a course is from the first lesson in January of the current course year.

Article 3 — Termination

3.1 Enrolment for a course applies for the duration of the full course year.

3.2 Early termination during the course year is not possible, except in the situations set out below.

3.2.1 The student gives written notice of termination before the end of the first term (autumn holiday) of the current course year.

3.2.2 The student moves outside the service area of Theaterschool De Zuiderlingen. Proof of change of address must be provided upon request.

3.2.3 The student is permanently unable to continue the course for medical reasons. Theaterschool De Zuiderlingen may request a statement from a doctor or other qualified healthcare provider.

3.3 Termination must be submitted via the designated cancellation form on the website of Theaterschool De Zuiderlingen.

3.4 Any refund of course fees resulting from a valid early termination will be processed in accordance with the provisions of Article 5 of these general terms and conditions.

Article 4 — Cancellation

4.1 If a student is unable to attend a class due to illness, absence or other circumstances, the student must notify the relevant teacher of their absence no later than 2 hours before the start of the class.

4.2 Notification of absence may be given by email, telephone or private message to the relevant teacher.

4.3 Classes missed by the student cannot be made up, unless Theaterschool De Zuiderlingen expressly decides otherwise.

4.4 Absence of a student, regardless of the reason, does not entitle the student to a refund of course fees, except in the cases specified in these general terms and conditions.

Article 5 — Refunds

5.1 Refunds of course fees are only possible in the cases referred to in Article 3 of these general terms and conditions.

5.2 A student's absence, regardless of the reason, does not entitle the student to a refund of course fees.

5.3 Classes missed by a student are not eligible for a refund.

5.4 If classes are cancelled due to circumstances attributable to Theaterschool De Zuiderlingen, the student shall be entitled to a refund from the third cancelled class within the same course year. Only the course fee relating to the cancelled classes is eligible for refund.

5.5 If Theaterschool De Zuiderlingen decides to terminate a course before its completion, the student shall be entitled to a refund of the course fee relating to the remaining classes.

5.6 If Theaterschool De Zuiderlingen decides to cancel a course or workshop before the start date, the course fee or workshop fee already paid shall be refunded in full.

5.7 Refunds of workshop fees are only possible if the participant cancels in writing no later than two weeks before the start of the workshop. No refund will be provided if cancellation takes place within two weeks before the start of the workshop.

5.8 If a student terminates enrolment pursuant to Article 3.2.1 before the end of the first term (autumn holiday) of the current course year, no refund shall be granted for the first term payment. Any course fees already paid relating to the remaining terms shall be credited or refunded.

Article 6 — Expression of Interest Registration

6.1 If a course is fully booked, an expression of interest registration may be submitted via the website of Theaterschool De Zuiderlingen.

6.2 An expression of interest registration serves solely as an indication of interest and does not confer any right to placement, admission or priority enrolment for a course.

6.3 If there is sufficient interest for an additional course group, Theaterschool De Zuiderlingen reserves the right to organise an extra course or course group. Persons who have submitted an expression of interest registration will be notified of this by email.

6.4 An expression of interest registration automatically expires at the end of the course season and will not be automatically carried forward to a subsequent course season.

Article 7 — Fees

7.1 The current fees for courses, workshops and other activities of Theaterschool De Zuiderlingen are published on the website.

7.2 All stated fees are in euros and apply to the relevant course or activity offering as published on the website.

7.3 Students aged 21 years and over will be charged the applicable VAT rate where legally required.

7.4 Theaterschool De Zuiderlingen reserves the right to adjust its fees. Fee changes shall not affect enrolments already concluded for the current course year, unless such changes result from statutory price increases or changes in taxes.

7.5 Different fees may apply to additional activities, projects, performances, workshops or special courses.

Article 8 — Payments

8.1 By enrolling in a course, workshop or activity, the student/participant, or their parent or legal representative, agrees to the applicable fees and the resulting payment obligation.

8.2 Upon enrolment, the student/participant may choose to pay the full course fee in one instalment or in four instalments.

8.3 If payment in instalments is chosen, instalment fees will be charged.

8.4 The student/participant shall ensure that sufficient funds are available in the designated account at the time of collection.

8.5 Non-participation in classes, workshops or activities does not release the student from the payment obligation.

8.6 For enrolments made up to and including the autumn holiday of the current course year, the full course fee shall be payable.

8.7 Students who enrol after the autumn holiday during the course year may qualify for an adjusted course fee pro rata to the remaining part of the course year.

8.8 Theaterschool De Zuiderlingen reserves the right to offer additional courses, workshops or activities during the course year for which different fees may apply.

Article 9 — Liability

9.1 Participation in courses, workshops, performances and other activities of Theaterschool De Zuiderlingen is entirely at the participant's own risk.

9.2 Theaterschool De Zuiderlingen shall not be liable for damage to, loss of or theft of property belonging to students, participants, visitors or other attendees.

9.3 Theaterschool De Zuiderlingen shall not be liable for injury, accidents or any other damage arising during or as a result of participation in courses, workshops, performances or other activities, unless such damage is the result of intent or gross negligence on the part of Theaterschool De Zuiderlingen.

9.4 The student/participant shall at all times remain responsible for his or her personal belongings.

9.5 Parents, guardians or legal representatives of minor students remain responsible for the supervision of their child outside class hours and outside activities organised by Theaterschool De Zuiderlingen.

Article 10 — Portrait Rights

10.1 By accepting these general terms and conditions, the student consents to the use by Stichting Theaterschool De Zuiderlingen of photographs and/or videos in which he or she is depicted.

10.2 If a student would prefer not to be recognisable in the images, they may indicate this by e-mail. For all questions you can contact us via [email protected]

Article 11 — Safety and Group Dynamics

11.1 Theaterschool De Zuiderlingen strives to provide a safe, respectful and inclusive learning environment for all students, teachers, volunteers and other persons involved.

11.2 Every student is expected to behave respectfully towards fellow students, teachers and other attendees and to contribute to a positive group dynamic.

11.3 If, through behaviour, attitude or actions, a student disrupts the safety, well-being or group dynamics of the course group, Theaterschool De Zuiderlingen reserves the right to take appropriate measures.

11.4 Such measures may include, among other things, a warning, a meeting with the student and/or their parent(s) or legal representative(s), temporary exclusion from classes, or permanent removal from the course group.

11.5 The assessment of whether a disruption as referred to in Article 11.3 has occurred shall be made solely by the management of Theaterschool De Zuiderlingen, if necessary after consultation with the relevant teacher.

11.6 A decision to temporarily or permanently remove a student from a course group does not automatically entitle the student to a refund of course fees already paid.
